What is stigmatizm?

Parents are often stigmatized as being unfit or incapable of parenting I just wondering when there is going to be a piece of legislation which wipes out
this type of stigma?

Soical stigma is soical disapproval of personal characteristics or belief against cultural norms. If you have a disability soiciety usually percieves you as lacking something not having mental capacity and being excluded because of it.

A disability can be either mental or physical and is a significantly restricted (or absent) ability, relative to an individual or group norm. The term is often used to refer to individual functioning, instead of understanding the nature of the disability for example parents are often stigmatized. There is a lot of stagmitizm against a parents ability and the out come is parents are precived as “unfit” or incapable.

Reference New Brunswick (Minister of Health and Community Services) v. G. (J.), [1999] 3 S.C.R. 46 J.G. S. 7 of the Charter. This right protects both the physical and psychological integrity of the individual and this protection extends beyond the criminal law and can be engaged in child protection proceedings. For a restriction of security of the person to be made out, the impugned state action must have a serious and profound effect on a person’s psychological integrity. The effects of the state interference must be assessed objectively, with a view to their impact on the psychological integrity of a person of reasonable sensibility. This need not rise to the level of nervous shock or psychiatric illness, but must be greater than ordinary stress or anxiety. State removal of a child from parental custody pursuant to the state’s parens patriae jurisdiction constitutes a serious interference with the psychological integrity of the parent. Besides the obvious distress arising from the loss of companionship of the child, direct state interference with the parent-child relationship, through a procedure in which the relationship is subject to state inspection and review, is a gross intrusion into a private and intimate sphere.

Further, the parent is often stigmatized as “unfit” when relieved of custody. As an individual’s status as a parent is often fundamental to personal identity, the stigma and distress resulting from a loss of parental status is a particularly serious consequence of the state’s conduct. A combination of stigmatization, loss of privacy, and disruption of family life are sufficient to constitute a restriction of security of the person.

None the less there still continues to be this type of stigma towards a person with disability for example I was forced to give up custody because there was a belief that I was mentally handicapped, the courts decsion I would not be able to parent or because of my emotional problems such as having anxiety or depression. What happens is it is really hard to fight because of this stigmatizam. Soicety in general usually sees the persons disability not there ability.

  2. hello there i have a friend with a dissability and her kids were aprehended by the ministry in bc, she has not been given the oppertunity to defend her rights and is just being pushed asside… do you know of anyone that could help her with this in my city of vancouver bc? in another article you said you have a website but didnt give it.
